Terms of Use

These terms govern your use of tekjobs.timurtek.com (the "Site"), the accounts and job-posting service offered on it (the "Service"), and the TekJobs software published at github.com/Timurtek/tekjobs (the "Software"). The Site and the Service are operated by Timurtek LLC, a Washington limited liability company ("we", "us"). By using the Site, creating an account, or buying a posting, you agree to these terms and to the Privacy Policy and Refund Policy. If you do not agree, do not use the Site or the Service.

1. The Software is separate, and open source

The Software runs on your own computer and is licensed to you under the MIT License in its repository. That license, not these terms, governs your use of the Software. The Software is provided "as is", without warranty of any kind, as the MIT License says. Nothing you do with the Software on your machine (which boards it reads, what it writes into your notes, what you send to an employer) is done by us or on our behalf, and we do not see it.

2. Accounts

You need an account to buy a posting. You must be at least 18 and able to enter a contract. You are responsible for what happens under your account and for keeping your sign-in method secure. Sign-in is provided through Google Firebase Authentication; we hold your email address and an identifier, not your password. You may delete your account at any time by writing to hello@timurtek.com; see the Privacy Policy for what is kept afterward.

3. Job postings

A posting is a description of a genuine, currently open position, submitted by you, that we distribute to TekJobs users as one more source their software may read and score. You represent that:

• you are authorised to post the position for the employer named in it;
• the posting is truthful, describes a real job that is open when posted, and states pay where the law of the job's location requires it;
• the posting complies with the employment and anti-discrimination laws that apply to it. Postings that discriminate on a protected basis, request payment from applicants, advertise multi-level-marketing or unpaid "opportunities" presented as jobs, or collect applicant data for any purpose other than hiring for the posted role are not permitted;
• you will not post anything unlawful, defamatory, infringing, or misleading.

We may decline, edit for format, or remove a posting that breaks these rules or that we reasonably believe does, and we may close an account that repeatedly does. Where a posting is removed for breaking these rules, no refund is owed.

A posting runs for the period stated at purchase (currently 30 days) or until you ask us to close it, whichever comes first. We do not promise that any TekJobs user will see, score, or apply to a posting; how a user's software treats it depends on criteria that user controls.

4. Payment

Prices are shown at checkout in US dollars. Payment is processed by Stripe under Stripe's own terms; we never receive or store your card number. Taxes are added where we are required to collect them. Refunds are governed by the Refund Policy.

5. Our content and yours

The Site's text, design and code are ours or our licensors', except the parts published under open-source licenses in the repository. You may not scrape, mirror or resell the Site or the postings on it. You keep the rights to the postings you submit and grant us a non-exclusive, worldwide licence to store, display and distribute them for the purpose of running the Service for the posting's term and a reasonable period after, and to keep records as the law requires.

6. Acceptable use

You will not attempt to gain access to accounts or data that are not yours, interfere with the Site's operation, send us or our users unsolicited bulk messages, or use the Service to collect personal data about job seekers beyond what hiring for the posted role needs.

7. Disclaimers

The Site and the Service are provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, that postings will reach any particular audience, or that any application, interview or hire will result from a posting. Job seekers using the Software do so with their own judgment; we are not a party to any application or employment relationship.

8. Limitation of liability

To the fullest extent permitted by law, Timurtek LLC and its members, officers and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Site, the Service or the Software, even if advised of the possibility. Our total liability for any claim arising from the Service will not exceed the amount you paid us for the posting that gave rise to the claim in the twelve months before the claim, or one hundred US dollars, whichever is greater. Some jurisdictions do not allow some of these limits; where they do not apply, our liability is limited to the extent the law allows.

9. Indemnity

You will defend and indemnify us against claims, losses and reasonable legal costs arising from a posting you submitted, your breach of these terms, or your violation of any law or of a third party's rights.

10. Termination

You may stop using the Site at any time. We may suspend or end your access to the Service if you break these terms, if the law requires it, or if we discontinue the Service, in which case any unused posting term is refunded as the Refund Policy describes. Sections 5 to 12 survive termination.

11. Changes

We may change these terms. The date at the top says when they last changed, and a material change is announced on the Site before it takes effect. Continuing to use the Service after that date means you accept the change; if you do not, stop using the Service and write to us about any posting still running.

12. Governing law and disputes

These terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Any dispute that cannot be settled by talking to us first will be brought in the state or federal courts located in Snohomish County, Washington, and you consent to their jurisdiction. Nothing here limits rights you have as a consumer under mandatory law in your place of residence.
